Welcome to Vitality74. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Vitality74, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use Vitality74. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Description of Service

Vitality74 is a physiological performance utility designed to provide:

  • Guided pelvic floor (Kegel) exercise training with biofeedback
  • Progress tracking and bio-analytics
  • Nutrition protocols and tracking
  • Personalized training recommendations based on the 74-day regeneration cycle

4. Medical Disclaimer

IMPORTANT: Vitality74 is for educational and general wellness purposes only. The App does not provide medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare provider before starting any exercise program
  • Do not use the App as a substitute for professional medical advice
  • If you experience pain, discomfort, or any concerning symptoms, stop using the App and consult a healthcare provider
  • The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition

5. User Responsibilities

When using Vitality74, you agree to:

  • Use the App only for its intended purpose
  • Provide accurate information during onboarding
  • Listen to your body and exercise within your limits
  • Not use the App if you have been advised against pelvic floor exercises by a healthcare provider
  • Not attempt to reverse engineer, modify, or distribute the App

6. Intellectual Property

All content, features, and functionality of Vitality74, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Vitality74 and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App or its content
  • Use the App for commercial purposes without authorization
  • Remove any copyright or proprietary notices
  • Create derivative works based on the App

7. Privacy

Your use of Vitality74 is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your information.

8. Purchases and Refunds

Vitality74 is available as a one-time purchase of $19.99 USD for lifetime access. All purchases are processed through the Apple App Store or Google Play Store. Refund requests are handled according to the respective store's refund policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of any information provided
  • Warranties that defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VITALITY74 AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, or goodwill
  • Any personal injury or property damage resulting from your use of the App
  • Any damages arising from your reliance on information provided by the App

11. Indemnification

You agree to indemnify, defend, and hold harmless Vitality74 and its affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vitality74 regarding your use of the App and supersede all prior agreements and understandings.
